Discussed two cases on the Hague International Child Abduction Convention: the House of Lords decision in Re M and Another (Children) (Abduction: Rights of Custody) [2008] 1 AC 1288 which finally decided that the court retained a discretion to order the return of wrongfully removed or retained children even if one of the defences has been established; and Central Authority v Houwert [2007] SCA 88 where the South African Supreme Court of Appeal discussed the nature of consent to removal, as well as the nature and extent of the order that could be made on a holding that the child had to be returned.
